These Terms and Conditions govern the terms under which you may access and use this website and the services associated with it (together, the "Service"). By accessing, registering with and using the Service, you agree to be bound by these Terms and Conditions. You also agree that you are explicitly giving us permission to send communications via email, phone or SMS to the details you provide. If you do not wish to be bound by these Terms and Conditions, do not access, register with or use the Service. In these Terms and Conditions, the terms "Credily", "we", "us", "our" refer to Credily, together with its employees, directors, affiliates, successors, and assigns.

Credily provides a verification, training, and compliance platform for universities and educational institutions and for the recruitment agencies and counsellors who represent them. Depending on your account type, the Service allows you to: verify the identity, business standing, and screening status of recruitment agencies; deliver and track counsellor training and qualification; conduct structured credibility interviews with applicants and receive scored reports; and maintain an audit-ready record of those checks. We agree to provide the Service to you using reasonable care.

If you are a recruitment agency or counsellor, you may apply through the Service to complete verification and, if approved, receive a verified badge and certificate. Applying for or holding a badge does not create any partnership, agency, or employment relationship with Credily. We may, in our sole discretion, choose whether to accept, decline, suspend, or revoke any verification, badge, training outcome, or account.

We will attempt to process verifications, training records, interviews, and other requests promptly, but any request may be delayed, declined, or cancelled for reasons including but not limited to: our efforts to verify identity or business registration; screening and adverse-media checks; our need to contact you or a third party; our compliance with applicable law; or the availability and accuracy of information provided by you or others.

Access to the Service is provided under a separate order form, subscription, or written agreement between you (or your institution) and Credily. Where charges apply, they become due as set out in that agreement. If your use of the Service results in Credily becoming liable for charges including but not limited to chargebacks or payment-processing fees, you agree to reimburse us for all such fees. You will provide us with true, accurate, current and complete information, including evidence of identity and business registration where requested, and you will promptly update that information if and when it changes.

A Credily verification, badge, credibility score, training outcome, or report reflects the checks completed at a point in time. It is not a guarantee of any person's or organization's future conduct, and it does not guarantee admission, enrolment, a visa, a partnership, or any other outcome. Any decision you take on the basis of Credily outputs remains your own.

We make no representations or warranties of any kind, express or implied, with respect to this website or its contents or its links and accept no legal liability for errors or omissions contained therein. In no circumstances (as permitted by law) shall we be liable for any losses, damages or claims arising or suffered as a result of any use of this website, its contents or its links.

We make no representations or warranties as to the security of any information (including, without limitation, personal information) you provide to any third party through our website links.

When you submit information through the Service, it is your responsibility to make sure all details are accurate before submission. Once a verification, interview, training assessment, or record has been submitted for processing it is not normally possible to change its details.

Fees, refunds and cancellation

You or your institution may cancel a subscription or order for the Service in accordance with the separate agreement between you and Credily. Unless that agreement states otherwise, fees already paid for a completed verification, interview, training assessment, or record are non-refundable, because the work has already been performed. We may apply a cancellation charge where permitted by your agreement.

If you wish to request a cancellation or refund, you must submit a written request to one of the contact points listed at the end of these Terms and Conditions, giving your name, your institution or agency name, the account or order reference, and the reason for your request.

Any refund we approve will be made to the original payment method and in the original currency. Adjustments may be made for any currency fluctuations that occur in the meantime, and you will be responsible for the difference. You agree to accept our decision in respect of any refund or cancellation request.

We will refund any amount we receive as a result of your account being charged more than once for the same order, or a payment failing while the amount is still debited from your account.

We do not, in any event, accept responsibility for any failure to perform the Service as a result of circumstances which could reasonably be considered to be outside our control, or any losses or delays arising out of the use of any internet service provider, or caused by any browser or other software which is not under our control, or errors on the website or with the Service caused by incomplete or incorrect information provided to us by you or a third party.

Information about you and your visits to our site

We process information about you in accordance with our company privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

Uploading material to our site

Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with any applicable laws and content standards. You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.

Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with applicable laws or content standards.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Jurisdiction and applicable law

The company will have the exclusive right to decide the jurisdiction over any claim (including non-contractual disputes or claims) arising from, or related to, a visit to our site.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the applicable law.

Arbitration

If any dispute arises between you and the company, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement and Terms and Conditions, the dispute shall be first referred to a sole Arbitrator who shall be an independent and neutral third party identified by the company. The place of arbitration shall be decided by the company. The arbitration proceedings shall be in the English language.

Variations

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
